General terms and conditions of business

As of September 2025

All deliveries and services are provided exclusively under the following General Terms and Conditions in their currently valid version.

1. Conclusion of contract

The customer's order constitutes an offer. A contract is only formed upon our acceptance. The customer will be notified of the acceptance via email. An order is only possible if all mandatory fields marked with an asterisk (*) in the order form are completed. If information is missing or we are unable to fulfill the order for other reasons, the customer will receive an error message. Before final submission of the order, the customer has the opportunity to correct it. Supporting details are provided to the customer directly during the ordering process. Once the order process is complete, the customer will be notified via an information window stating, "Your order is complete and has been successfully sent to us." This does not yet constitute acceptance of the customer's offer on our part.

2. Acknowledgement of receipt

Once we receive the order, the customer will be notified of its receipt via the email address they provided. This notification does not yet constitute acceptance of the customer's offer on our part.

3. Customer loyalty to the offer

The customer is bound to the order for 2 days from receipt of this order. The statutory right of withdrawal (right of cancellation) remains unaffected.

4. Contract storage

We save the purchase agreement. If the customer wishes to print the contract text after placing their order, they can do so as follows: Directly from the confirmation email. Alternatively, they can log in to the system using the link " https://www.sticklett.at/account/ " on the website and the user data (email address, password) provided during the ordering process. The order details can then be viewed and printed in the account view.

5. Contract language

The contract language is German.

6. Destination country

Our offer is aimed at customers residing or habitually resident in Austria, Germany, Liechtenstein, Luxembourg, and Switzerland. We also deliver throughout the EU and internationally.

7. Prices and shipping costs

All prices are total prices. They include all taxes, including VAT, and plus a flat shipping fee for deliveries within and outside of Austria. For deliveries to the Prices in Switzerland do not include Austrian VAT. According to EU trade agreements, additional customs duties may apply to deliveries outside the EU.

8. Payment methods

We accept the following payment methods: PayPal, credit card, Amazon Pay, purchase on account with Klarna, Apple Pay, Google Pay;

9. Due date

Unless the payment method "purchase on account with Klarna" has been agreed upon, the customer is obligated to pay the full purchase price upon conclusion of the contract. Delivery of the goods will take place after we have received confirmation of payment.

10. Right of withdrawal/cancellation

The term "right of withdrawal" used in Austria corresponds to the term "right of cancellation" used in Germany and in the Consumer Rights Directive. We therefore use the synonymous pair of terms "right of cancellation (right of withdrawal)." The cancellation policy uses only the term "right of cancellation." This is equivalent to the Austrian term "right of withdrawal."

11. No right of withdrawal (right of cancellation)

For goods, especially clothing, the right of withdrawal (right of cancellation) is void if the goods have been washed by the customer after delivery.

In the case of a rental agreement (e.g., the Mary rental edition by sticklett), the customer can terminate the rental at any time. The rental ends upon receipt of the goods after they have been inspected and a clear written cancellation notice has been received via email or through the Help Center. The goods must also be returned to us. If two monthly rental payments are missed without the device being returned and the rental agreement being terminated, a claim for damages equal to the device's list price will be due and enforced. Rental payments already made are non-refundable.

12. Information on the statutory warranty

The statutory warranty provisions apply. The warranty period for movable goods is two years from the date of delivery. Wear and tear and signs of use are not covered by the warranty.

Products provided free of charge as part of product tests, competitions, or other giveaways are not subject to statutory warranty, return, or exchange rights. Private resale of such products also does not provide any warranty to the buyer.

13. Warranty

For marked products, sticklett technologies GmbH provides a voluntary manufacturer's warranty of 2 years from the date of purchase. The warranty covers defects in materials and workmanship under normal use. It includes, at the manufacturer's discretion, repair or replacement of the defective product. Excluded from the warranty are damages caused by improper use, unauthorized modifications, normal wear and tear, and external influences. The warranty applies to purchases and deliveries within the European Union and Switzerland and does not affect statutory warranty rights.

14. Exclusion of liability for slight negligence

Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to items accepted for processing, nor to product liability claims. In the case of negligent handling, such as disregarding the clearly marked application and care instructions and the resulting consequences, www.sticklett.at excludes liability for damages.

15. Delivery period

Unless otherwise agreed, we will ship within 1-2 working days after our confirmation of the concluded contract.

16. Retention of title

The goods remain our property until full payment is received.

Rented products (e.g., the Mary rental edition by sticklett) remain our property until all rental fees have been paid in full for one year. After 12 months of payment, ownership transfers to the renter, and no further charges will be incurred. In case of loss or theft, either the rental fees for the remaining 12 months will continue to be due, or the remaining purchase price, less the previously paid rental fees, will be immediately due based on the current list price.

17. General

The invention, which provides for the variable attachment and removal of appliqués on clothing, is protected by a patent registered with the Austrian and German patent offices.

18. Severability Clause

Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions or the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that most closely approximates its intended meaning and economic purpose.

19. Contract Law

These terms and conditions are governed by Austrian substantive law, excluding the conflict-of-laws rules of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG). For all disputes arising from or in connection with these terms and conditions, the exclusive jurisdiction of the court with subject-matter jurisdiction for 9020 Klagenfurt am Wörthersee (Austria) is agreed.
