General Terms and Conditions, as of February 2022
All deliveries and services are provided exclusively subject to the following General Terms and Conditions in their currently valid version.
The customer's order constitutes an offer. A contract is only concluded upon our acceptance. The customer will be notified of acceptance by email. An order with advance payment is only possible if all mandatory fields marked with * on the order form are completed. If information is missing or if we are unable to process the order for other reasons, the customer will receive an error message. Before the order is finally submitted, the customer has the opportunity to correct their order. The customer will receive detailed supporting information directly during the ordering process. As soon as the order process is complete, the customer will be notified via an information window stating "Your order is complete and has been successfully sent to us." This does not constitute acceptance of the customer's offer on our part.
Once we receive the order, the customer will be notified of receipt of their order via the email address they provided. This notification does not constitute acceptance of the customer's offer on our part.
The customer is bound to their order for two days from receipt of the order. The statutory right of withdrawal remains unaffected.
The purchase contract is stored by us. If the customer wishes to print the contract text after placing their order, they can do so as follows: Directly from the confirmation email. They can also log in to the system using the link " https://www.sticklett.at/account/ " on the website and the user data (email address, password) provided during the ordering process. The order data can be viewed and printed in the customer account view.
The contract language is German.
6. Destination country
Our services are aimed at customers residing or ordinarily resident in Austria, Germany, Liechtenstein, Luxembourg, and Switzerland. We also deliver throughout the EU and internationally.
All prices are total prices. They include all taxes, including VAT and information, plus a flat shipping fee for deliveries within and outside of Austria. According to EU trade agreements, additional customs fees may apply for deliveries outside the EU.
We accept the following payment methods: Paypal, credit card, EPS transfer, Amazonpay, purchase on account with Klarna, Apple Pay, Google Pay;
If the payment method "Purchase on account with Klarna" has not been agreed upon, the customer agrees to pay the purchase price in full upon conclusion of the contract. Delivery of the goods will take place after we have received confirmation of payment.
The term "right of withdrawal" commonly used in Austria corresponds to the term "right of cancellation" commonly used in Germany and used in the Consumer Rights Directive. We therefore use the synonymous term "right of withdrawal" and "right of cancellation." In the cancellation policy, the term "right of withdrawal" is used exclusively. This is synonymous with the Austrian term "right of withdrawal."

For goods, especially clothing, the right of withdrawal (right of cancellation) no longer applies if the goods have been washed by the customer after delivery. For hygiene reasons, the right of withdrawal for face masks no longer applies once the customer has taken possession of them.
In the case of rentals (e.g., the Mary Rental Edition by sticklett), the customer can terminate the rental at any time. The rental period ends upon receipt of the goods after they have been inspected and upon clear written cancellation by email or through the Help Center. The return shipment is also made to us. If two months' rental payments are missed without returning the device and terminating the rental agreement, a claim for damages in the amount of the device's list price will be due and enforceable. Rental payments already paid are non-refundable.
The statutory warranty provisions apply. The warranty period for the delivery of movable goods is two years from receipt of the goods.
.In addition to the statutory warranty, we provide a 2-year guarantee on marked products.
Claims for damages in cases of slight negligence are excluded. This does not apply to personal injuries or damage to items accepted for processing, nor to product liability claims. In cases of negligent handling, for example, failure to follow the marked application and care instructions and the associated consequences, sticklett.com's liability for damages is excluded.
Unless otherwise agreed, we will ship within 1-2 business days after our confirmation of the concluded contract.
The goods remain our property until full payment has been made.
Rented products (e.g., the Mary Rental Edition by Sticklett) remain our property for up to one year of fully paid rent. After 12 months, ownership transfers to the renter, and no further charges are made. In the event of loss or theft, either the rent will continue to be due until the 12-month period has been paid, or the remaining purchase price, less the rent paid so far, will be immediately due.
The invention, which allows for the variable attachment and removal of appliqués on clothing, is protected by a patent filed with the Austrian and German patent offices.
18. Severability Clause
Should individual provisions of these General Terms and Conditions be and/or become invalid, this shall not affect the validity of the remaining provisions and the contracts concluded under them. The invalid provision shall be replaced by a valid provision that most closely approximates the meaning and economic purpose of the invalid provision.
19. Contract law
These Terms and Conditions are governed by Austrian substantive law, excluding the conflict of law provisions of private international law and the UN Convention on Contracts for the International Sale of Goods. For all disputes arising from or in connection with these Terms and Conditions, the exclusive jurisdiction of the court with subject-matter jurisdiction for 9020 Klagenfurt am Wörthersee (Austria) is agreed.
